1. Who we are and how these terms work
These terms apply to everything you buy from The Little Urban Flower Farm. Please read them before you check out. By completing your purchase, you agree to them.
Simone Hill trading as The Little Urban Flower Farm. ABN 96 930 160 090.
"We", "us" and "our" means The Little Urban Flower Farm. "You" means the person buying.
Questions about anything here? Email me at [email protected]. I'm the founder and I read every email.
You need to be 18 or over to buy from us.
2. Your rights under Australian Consumer Law
Nothing in these terms takes away your rights under the Australian Consumer Law. Where a term below seems to say otherwise, the law wins.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our services, including online courses and workshops, also come with consumer guarantees: they must be provided with due care and skill, be fit for any purpose we've told you about, and be delivered within a reasonable time.
3. What you're buying
The Flower Growing Year is a 12-month membership. It includes:
a monthly package posted to your letterbox, with that month's seeds, a printed instruction card and a letter from me
short, approachable step-by-step videos for each flower, in our online course platform
monthly emails and a Spotify playlist
weekly Q&A sessions in The Potting Shed, our private Facebook group (optional)
an invitation to become a Close Friend on Instagram (optional)
lifetime access to the online modules from your 12 months (see section 8)
What's included in each intake is described on the sales page at the time you buy. We may swap a flower or variety if seed supply or the season requires it, and we'll replace it with something of similar value.
Online courses (including stand-alone and mini courses) are digital only. Nothing is posted to you.
Workshops, face-to-face or live online, are covered in section 7.
4. Orders, prices and payment
All prices are in Australian dollars and include GST.
Payment is taken in full at checkout through our payment providers. We don't store your full card details.
Each monthly intake of The Flower Growing Year is limited to 25 members and closes when full or at the advertised closing date.
We may change prices for future purchases. A price change never affects an order you've already paid for.
If we make an obvious pricing error, we'll contact you before going ahead. You can choose to pay the correct price or cancel for a full refund.
We can decline or cancel an order, for example if a product is sold out or an intake is full. If we do, we'll refund you in full.
Payment plans. You can pay in two equal instalments: 50% at checkout and 50% one month later, with no extra fees. You're buying the whole product, so the second instalment is still owed even if you stop using it. If the second payment doesn't go through, I'll email you, and we may pause your packages and online access until it's paid.
5. Postage, delivery and seeds
We post within Australia only.
Most of Australia: your package goes out each month by regular Australia Post. It isn't tracked.
Western Australia and Tasmania: quarantine rules limit how seeds can be sent, so you'll receive all your course seeds in one Express Post delivery at the start of your membership. Your printed cards and letters still arrive monthly by regular post.
Lost packages: if a package hasn't arrived within a reasonable time, email me. I'll send a replacement with your next month's package.
Change of address: email me before the next mail-out and I'll update it. Please keep your details current, as we can't resend packages that went to an old address you didn't update.
Seeds are a living product. We source them carefully and store them well, but germination depends on conditions in your garden, including weather, soil, water and timing. Follow the instructions on the card and seed packet.
6. Changing your mind, cancellations and refunds
Due to the digital nature of the membership and the immediate access you get to the online content, we don't offer cancellations or refunds if you simply change your mind, so please read the sales page carefully before you buy. Workshops have their own rules, in section 7.
Seeds are sourced pre-packed, or bought and packed for each intake. The same applies to online courses once you can access them.
You can still get a refund, replacement or other remedy where the Australian Consumer Law gives you one. For example, if something is faulty, not as described, or we don't deliver what you paid for. Email me and I'll sort it out.
If you'd like to stop receiving your monthly package, or have it sent to someone else, just email me.
7. Workshops
Workshop places are limited, so a booking holds your spot.
Transfers: if you can't make it, email me and I'll move your booking to another date where one is available.
Sending someone else: you can send a friend in your place at any time. Just email me their name.
Cancelling more than 14 days before the workshop: you'll get a 50% refund.
Cancelling within 14 days of the workshop: there's no refund, but you can still transfer or send someone in your place.
If we cancel or reschedule: you can move to the new date or get a full refund.
Live online workshops: you'll need a reliable internet connection. If a recording is offered, we'll tell you when you book.
Face-to-face workshops: you may be working with soil, compost, potting mix, plant material, wire, sharp tools and other materials that may technically be considered hazardous. Please follow the safety instructions on the day and let me know about any allergies before you arrive.
8. Your access to online content and the community
Your login is for you alone. Please don't share it.
We aim to keep the course platform running smoothly, but sometimes there will be outages or maintenance. If something won't load, email me and I'll help.
"Lifetime access" for The Flower Growing Year covers the modules taught during your 12 months, including any extra material we later add to those modules. It doesn't include new modules, courses or flowers we offer in the future. "Lifetime" means for as long as we run the course. If we ever close it, we'll give you reasonable notice so you can download what you're entitled to keep.
Our private Facebook group is optional. Please be kind, keep it about growing, and don't sell or promote in it. We can remove posts or members who make the group unpleasant or unsafe for others.
Growing questions: all course questions are answered in the weekly Q&A in The Potting Shed, our private Facebook group, so every member benefits from every question and answer. The membership is priced low because it isn't personal advice, so I can't answer growing questions one-on-one by email or private message. Email is still the place for questions about your order, postage or login.
Removing you from the group for poor behaviour doesn't affect your monthly packages.
9. Copyright: what you can and can't do
Everything in our courses and packages belongs to The Little Urban Flower Farm: the videos, cards, letters, worksheets, photos and written content, plus our emails, newsletters, marketing messages, sales pages and social media posts. The Little Urban Flower Farm name and branding are ours too.
You can:
watch, download and print the materials for your own personal use
grow, pick, gift and enjoy the flowers you grow
share photos of your own garden and flowers, and tag us. We love seeing them.
You can't:
share your login, or pass on the videos or materials to people who haven't bought them
copy, republish or resell our materials, emails or marketing messages, in whole or in part, or use them to teach, promote or sell your own course, workshop or product
present our content as your own
If you'd like to use something of ours in a way not listed here, email me and ask.
10. Your photos and posts
You own the photos and words you post in our community.
If I'd love to share your photo or comment (on social media, in an email or on the website), I'll ask you first, and I'll credit you if you'd like. Please only post photos you have the right to share.
11. Gardening results, safety and liability
I'll teach you everything I know, but I can't promise every seed will come up or every flower will bloom. Results depend on your climate, soil, season and care.
Plant safety: some flowers and seeds are toxic if eaten, or can irritate skin. Keep seeds away from children and pets, wear gloves where advised, and check before eating anything you grow.
Your garden, your call: potting mix, soil, compost, vermiculite and the other materials we use are wonderful for growing, but they can carry health risks for some people. Potting mix and compost can contain bacteria, including the one that causes Legionnaires' disease, and fine dusts can irritate your lungs. Australian guidelines recommend wearing a dust mask and gloves when handling them, opening bags slowly away from your face, keeping mix damp, and washing your hands afterwards. Read the warning on the bag, and take extra care if you're older, smoke, or have a health condition. Use tools, ladders and equipment safely and according to their instructions. In the end, it's your garden and your call.
General information: our content is general gardening education. It isn't tailored advice for your property.
To the extent the law allows, we aren't liable for indirect loss (like lost profits) arising from our products. This doesn't limit any liability we have under the Australian Consumer Law, or for loss caused by our own negligence or breach of these terms.
12. Privacy, complaints, changes and governing law
Privacy. We collect your name, email and postal address to deliver your order and stay in touch. We don't sell your details. Our Privacy Policy explains how we collect, use and protect your information.
Complaints. If something isn't right, email me first. I'll respond within 5 business days and work with you to fix it. If we can't resolve it together, you can contact NSW Fair Trading.
Changes to these terms. We may update these terms from time to time and will show the date of the latest version at the top. The terms that apply to your purchase are the ones in place when you bought.
Governing law. These terms are governed by the laws of New South Wales, Australia. If any part of them is found to be invalid, the rest still applies.
